LIMITED WARRANTY; DISCLAIMERS; LIMITATION OF DAMAGES

A. ALL SALES ARE FINAL AND NONREFUNDABLE. Except as expressly warranted below, all sales are final and no refunds will be issued therefore for any reason.

B. LIMITED WARRANTY: Glenn Pro Products warrants that this product is free from material defects for a period of 30 days following receipt thereof by Purchaser. This warranty only applies to the first use of the product. This warranty does not apply to any use of the product other than for its intended purpose. Purchasers sole remedy for a defective product discovered within 30 days of receipt thereof is the replacement of the product. In order to exercise this warranty, purchaser must notify Glenn Pro Products of the defect within 30 days of receipt thereof, and return the defective product to Glenn Pro Products within one week following discovery of the defect.

C. NO OTHER WARRANTIES: THE FOREGOING IS GLENN PRO PRODUCTS ONLY WARRANTY AND GLENN PRO PRODUCTS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, USAGE OF TRADE, AND FITNESS FOR A PARTICULAR PURPOSE.

D. LIMITATION OF DAMAGES: GLENN PRO PRODUCTS LIABILITY FOR ANY DAMAGES OR INJURIES SUFFERED AS A RESULT OF PURCHASERS OR THIRD PARTY’S USE OF THIS PRODUCT, WHETHER BASED ON BREACH OF CONTRACT OR WARRANTY, CLAIM OF NEGLIGENCE, MISREPRESENTATION OR OTHER TORT, OR ON ANY OTHER LEGAL OR EQUITABLE THEORY, SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID TO GLENN PRO PRODUCTS BY PURCHASER FOR THE PRODUCT. UNDER NO CIRCUMSTANCES SHALL GLENN PRO PRODUCTS BE LIABLE TO PURCHASER OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOSSES FROM BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS), REGARDLESS OF WHETHER GLENN PRO PRODUCTS HAS BEEN WARNED OF SUCH DAMAGES OR CLAIMS. NO ACTION MAY BE BROUGHT AGAINST GLENN PRO PRODUCTS RELATED TO THE SALE OF THE PRODUCT MORE THAN ONE YEAR AFTER PURCHASER KNEW OR SHOULD HAVE REASONABLY KNOWN OF THE FACTS GIVING RISE TO SUCH CLAIM OR ACTION.
